This document establishes the conditions that apply to sales between the persons who wish to make a purchase on this website, hereinafter referred to as ‘the customer’ and HEMP TRADING, S.L.U., (hereinafter HEMP TRADING).

By making use of this website or the customer’s purchase request constitutes acceptance of the conditions of purchase and our Data Protection policy, which the customer must consult and accept prior to the purchase of the product. These conditions of purchase may vary. It is the customer’s responsibility to read them periodically, as those in force at the time of purchase will be applied at the time of purchase. Users of this website declare that they are of legal age and have all the legal capacity necessary to adhere to these general conditions and accept them without reservation. They also undertake to provide truthful and up-to-date information on the data provided in forms, orders or any other use of this website.

1/ Purpose and scope of application
The user declares that he/she is aware, at the time of placing the order, of the specific conditions of sale indicated on each product sheet (duration, price, etc.) and expressly declares that he/she accepts them without reservation. The placing of the order and its confirmation by the user makes him/her a customer and implies full and complete acceptance of the specific conditions of sale, applicable only to the order, as well as acceptance of the other legal documents published on the website as well as in the legal notice and the privacy policy.

2/ Purchasing processes
To purchase the products offered, the following steps must be followed:
Product selection: Browse our website and click on the ‘Add to Cart’ button each time you wish to add a product to the shopping cart. The shopping cart contains the name of the selected product, the quantity and the price in euros.
Start the purchase process: to start the purchase process, click on the ‘Checkout’ button. You will be asked to provide your billing details.
Verification of the purchase data: Before proceeding with the payment you will be able to verify your purchase data and correct any error in the data entry. Once you have verified your details, confirm your order.
Confirmation of purchase: Once we receive your acceptance, HEMP TRADING will issue an on-screen confirmation which you can save and which will contain the following information:
– Order number.
– Order date.

– Summary of the products included in the purchase.

Payment of the order: Payment of the order can only be made by bank transfer. At the time of purchase confirmation, the system will confirm that your order has been registered and will indicate the bank details of HEMP TRADING to make the bank transfer.
At the moment you make the bank transfer, the contract will be completed to all effects and purposes.

3/ Product specifications and information provided
The information shown on the website is truthful and free of typographical errors. In the event of any error of this type occurring at any time, beyond the control of HEMP TRADING, it will be corrected immediately.

4/ Languages for the purchase of products
Purchases made by customers shall be understood to be binding only in Spanish.

5/ Terms of payment
In order to formalise the purchase, the user will have to use bank transfer or credit or debit card through the payment gateway as a method of payment. The HEMP TRADING bank details provided must be used responsibly by the customer.

The bank transfer shall be governed by the contractual terms and conditions of the customer’s bank. However, if you wish to pay by credit or debit card, you will be redirected to the platform offered by our bank.

In any case, HEMP TRADING is completely unaware of the data provided in the payment gateway and has no access to the private data provided.
The client must notify HEMP TRADING of any undue or fraudulent charge in the payment system used by e-mail to the address pedidos@buddhaseedbank.com or by telephone at: +34 96 120 37 87 as soon as possible so that HEMP TRADING can take the appropriate steps.

6/ Price
All prices are indicated by default in euros. The price indicated includes the taxes applicable to the transaction. The price and conditions of the products offered may vary, but in any case the price and conditions that existed when the order was placed will always apply to the user.
In the event of an error in the final price of any of the items displayed, HEMP TRADING undertakes to inform users as soon as possible of the new selling price, offering affected customers the possibility of reconfirming the order, or the possibility of withdrawing from the purchase on their part. If it is not possible to contact the user, the order will be considered cancelled and the amount of the incorrect price paid will be refunded.

7/ Receipt of the products
We will send the customer the products to the delivery address that appears in the address indicated as the delivery address on the corresponding form.

On receipt of the products, the customer undertakes to sign the receipt form presented by the person making the delivery, on which he/she may include any observations he/she deems necessary. By signing the receipt form, the customer acknowledges having received the number of packages indicated on the form. If the customer notices damaged products or missing products, he/she must make a complaint by e-mail to info@buddhaseedbank.com within a maximum period of 24 hours in order to report it to the insurance company of the transport company. This does not limit the right of guarantee and conformity of the non-perishable product described in paragraph nine.

8/ Availability of the product:
8.1/ Availability of the products
The availability of products on the website is updated according to stock. All product orders are subject to product availability. HEMP TRADING will not intentionally offer for sale more units than are available in stock. If due to uncontrollable causes or unwanted errors, a product not available in stock is offered for sale and is purchased by a user, HEMP TRADING undertakes to act in good faith and offer the user the possibility of:

– Refund any amount that may have been paid without any penalty through the same means by which it was made.

– Replace by another model of equal quality and value available in stock with the consent of the customer.

– If there is a possibility of the product being available, send it within a new delivery period.

8.2/ Delivery times and costs:
HEMP TRADING delivers in Europe and America. If you wish to receive the products in other territories, please contact us by e-mail at info@buddhaseedbank.com.
Delivery times will vary depending on the availability of the products selected and the address to which they are to be delivered. In any case, the delivery time will not exceed 15 working days, being the usual delivery time between 48-72h for shipments within the Iberian Peninsula from Monday to Friday.
The shipping costs will be shown individually in each process of the purchase, since the quantity and variety of products added to the shopping cart influence both the final amount and the weight of the transport.
Shipments in the Peninsula, Balearic Islands and Portugal are free for purchases of 50€ or more. Otherwise, the shipping cost is 5€ + VAT.
In the rest of the EU countries, shipping will be free on purchases of 50€ or more. Otherwise, the cost of postage is 10 € + VAT.
The costs indicated above are approximate and will vary depending on the place of delivery and the dimensions of the package.
Once we send you the shipping confirmation you will have all the information about your shipment, tracking number and details of the agency, so you can track the order, either by phone, by contacting the agency or through the web platform that our agency makes available to you, in order to be informed or in the case of impossibility to be at the shipping address to change the address or day of delivery.

In the event that the agency is unable to deliver the package due to absence at the address provided, they will leave a note or try to locate you by phone or email, to arrange another delivery date.

The package will be considered as delivered when the customer, or a third party acting on his behalf, takes possession of the package, which will be accredited by a signature upon receipt of the package.

It is up to the customer to verify that their details are correct, in order to avoid incidents in the delivery of the package, particularly in the address and contact details such as telephone and email to be able to locate you correctly.

HEMP TRADING will keep the customer informed by mail or phone call of any incident that may arise, in order to solve as soon as possible and in the case of not being able to meet the delivery date we will inform you of this circumstance and we will give you the option to continue with the order with a new delivery date or cancel with a full refund of the price paid. If this happens due to bad information in the delivery details or due to the absence of the customer at the delivery address, it will always be the responsibility of the customer, who must assume the costs of managing the delivery to the correct address or return, and never the responsibility of the transport agency or HEMP TRADING.

Finally, it should be noted that certain situations, beyond the control of HEMP TRADING, may cause delays in the delivery of orders, for example, but not limited to, states of alarm, confinement orders, situations of force majeure (such as earthquakes and floods), transport strikes that delay, prevent or cause the supply to suffer any incident.
If several products have been ordered at the same time, HEMP TRADING may deliver the different items in the shopping cart on different dates, depending on the availability of each one.
All international shipments, as well as shipments to the Canary Islands, Ceuta and Melilla will be accompanied by an import/export declaration to the customs authorities. This document reflects the total amount of the order. The customer must pay any international taxes or duties levied on the products in the territory of collection.

9/ Conformity of the products
All products shall be deemed to be in conformity with the conditions of the present document provided that:
a) They conform to the description given and possess the qualities of the product that HEMP TRADING has presented to the consumer in the form of a sample or model.
b) They are fit for the uses to which products of the same type are ordinarily put.
c) They are suitable for any special use required by the consumer when the consumer has made this known to HEMP TRADING at the time of conclusion of the contract, provided that HEMP TRADING has accepted that the product is suitable for such use.
(d) they are of a quality and performance that is customary for a product of the same type and which the consumer can reasonably expect, taking into account the nature of the product and, where applicable, public statements on the specific characteristics of the products made by HEMP TRADING, in particular in advertising or on labelling. HEMP TRADING shall not be bound by such public statements if it proves that it was unaware and could not reasonably be expected to have been aware of the statement in question, that the statement had been corrected at the time of conclusion of the contract or that the statement could not have influenced the decision to purchase the product.

For clarification purposes, general damage caused by improper or abnormal use of the product shall not be accepted as a defect.

Any warranty shall be void if the product is tampered with by personnel not authorised for this purpose by the manufacturer. All other claims are excluded with the exception of the rights held by the purchaser against the manufacturer in accordance with the legislation in force.

In cases where the Customer considers that at the time of delivery the product, whether perishable or not, does not conform to the stipulated (other than the right of withdrawal of products provided in the following section), you should contact us immediately by email info@buddhaseedbank.com indicating the details of the order, as well as the damage suffered or the error in the product served, where we will indicate how to proceed.

10/ Right of withdrawal,
Products purchased through HEMP TRADING, in the event that any of the exceptions provided for in article 103 b, c, d and e of the Revised Text of Consumers and Users apply, may not be subject to the right of withdrawal, that is to say:
– The supply of goods or the provision of services whose price depends on fluctuations in the financial market which the entrepreneur cannot control and which may occur during the withdrawal period.
– The supply of goods made to the specifications of the consumer and user or clearly personalised.
– The supply of goods that are likely to deteriorate or expire quickly.

– The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

On the other hand, in the event that it is possible to exercise the right of withdrawal, it is necessary that the product has not been opened or modified and is returned in its original packaging, and with all its components, otherwise the good could suffer depreciation or breakage. Before returning the product, the customer must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.

11/ Returns

a) Returns for exercising the right of withdrawal

The customer must notify us of their wish to exercise their right of withdrawal within 14 calendar days of receiving the product. For convenience, we provide a model form in this link, once completed, can be sent to the email address info@buddhaseedbank.com.
In any case, the customer shall return the products subject to withdrawal without undue delay within a maximum period of fourteen (14) calendar days from the date on which he/she communicates his/her decision to withdraw at his/her own expense.

For its part, the refund of the amount corresponding to the withdrawal will be made within fourteen (14) calendar days from the date on which the decision to withdraw from the Contract has been effectively and unequivocally communicated and provided that HEMP TRADING has previously received the product. Otherwise, the payment may be withheld until receipt of the product or until the customer proves that the product has been returned.

After analysing the returned product(s) and verifying their condition, the amounts received will be refunded. Said refund will include the total amount of the purchase, including, where applicable, the delivery costs (with the exception of the additional costs resulting from the customer’s choice of a delivery method other than the least expensive ordinary delivery method that we offer) and will be made using the same means of payment with which the product was purchased.

b) Returns of defective products.

In cases where you consider that at the time of delivery the product does not conform to the stipulations of the contract, you should contact us immediately via our contact form providing details of the product and the damage it suffers.

We will carefully examine the returned product and will inform you by e-mail or telephone, within a reasonable period of time, if the product is to be returned or replaced (if applicable).

The return or replacement of the item will be made as soon as possible and in any event within 14 calendar days from the date on which we send you an e-mail confirming the return or replacement of the non-conforming item.

The amounts paid for those products that are returned because of a defect or defect, when it actually exists, will be refunded in full, including the delivery costs incurred to deliver the item to you.

The refund will be made in the same payment method that was used to pay for the purchase, if that is your decision, we may send you a voucher for your next purchase to compensate. If the shipping cost was free and after the return the total amount of the order does not exceed the minimum amount requirement, the shipping cost will be deducted from the amount to be refunded.

12/ Delivery and replacement of erroneous products
Although we will always try to ensure that your orders are correct, in the event that HEMP TRADING makes a mistake in the supply of the products selected, we will always bear the costs incurred in collecting and replacing the correct item(s).

13/. Reimbursement of amounts paid.
The refund, where applicable, will be made through the means of payment used for the purchase.
The price to be refunded is the price that originally appeared on the order, including shipping costs. Once the correct condition of the returned product has been verified, HEMP TRADING will refund the total amount originally stated on the order (including the first shipping costs), without undue delay and, in any case, within 14 calendar days from the date on which we have been informed of the withdrawal decision.

14/ Information requested
In accordance with the provisions of the data protection regulations, we inform you that the personal data you provide us with through our website or by sending us e-mails will be processed by HEMP TRADING as the data controller in order to carry out the transactions requested, as well as to receive periodic notifications by electronic means. The legitimacy of the processing lies in the provision of the services requested. You can find more information about the processing of your data and the purposes described in the privacy policy, which must be read, understood and accepted in order to use the services of this website.

HEMP TRADING undertakes to comply with the obligation of secrecy of personal data, and has therefore adopted the necessary measures to prevent its alteration, loss, unauthorised processing or access, taking into account the state of technology at all times.

In any case, all users have the right to exercise, at any time, the rights of access, rectification, limitation of processing, suppression, opposition, limitation of processing, and portability of data, by writing to HEMP TRADING at the e-mail address info@buddhaseedbank.com, accrediting their identity . In the event that you consider it necessary, you may file a complaint with the Spanish Data Protection Agency.

15/ HEMP TRADING’s exemption from liability
There are countries in which the purchase of cannabis or hemp seeds is illegal and/or it is illegal to plant and germinate them. It is the responsibility of the customer to inform himself about the legislation of the country of residence before placing an order and to act accordingly.

Possession of cannabis seeds in Spain is not a criminal offence. However, the cultivation of cannabis may be subject to administrative and criminal sanctions according to art. 25.1 of the Organic Law for the Protection of Public Safety and art. 368 of the Penal Code.
The customer who purchases our products is responsible for the use he makes of them, without HEMP TRADING inducing any use that is not legally permitted.

You should not place an order if you are a minor. HEMP TRADING shall not be liable in those cases in which it is the responsibility of the parents, guardians or legal representatives of underage or incapacitated users to authorise access, supply of personal information or use of the website or the contracting of any products or services provided through this website.

16/ Applicable legislation. Submission to jurisdictions.
The sale is understood to have been made in Spanish territory, and therefore, for any interpretative or litigious issues that may arise, Spanish legislation will be applicable and, in the event of any dispute, both parties agree to submit to the jurisdiction of the Courts and Tribunals of the consumer’s domicile, renouncing any other jurisdiction that may correspond to them.
