Cannabis seeds are not controlled by the 1961 Single Convention on Narcotic Drugs, signed in New York on March 30, 1961, and amended by the Geneva Protocol of March 25, 1972, ratified by Spain.
The Single Convention specifies which parts of the Cannabis Sativa L. plant are regulated; flowering or fruiting tops, as well as resin extracted from the cannabis plant, are controlled, but seeds are explicitly excluded. Therefore, the seeds are not legally considered as cannabis and are not included in the annexed lists.
Cannabis Sativa L. seeds do not contain Delta-9 tetrahydrocannabinol (THC), the active ingredient.
Accordingly, under the Single Convention, cannabis seeds are not controlled and are not classified as narcotic drugs.
In Spain, selling, possessing and cultivating cannabis seeds for personal use is not a crime. The Spanish Penal Code considers it a crime to cultivate cannabis with the objective of promoting, favoring or facilitating its consumption by third parties.
The Prosecutor of the Supreme Court, Mr. Fernando Sequeros Sazatornil, determined that the sale of cannabis seeds in quantities suitable for home cultivation and self-supply cannot be considered a crime.
The cultivation of cannabis for personal use may be an administrative offense if it is carried out in places visible to the public, according to Article 36.18 of Organic Law 4/2015, of March 30, on the protection of citizen security.
Hemp Trading, S.L. seeds are not commercial varieties and are not intended for agriculture. They are available for personal use by persons over 18 years of age. Hemp Trading, S.L. markets the seeds as objects of collection or genetic preservation, with the restriction of not using them in contravention of current law.
In accordance with the principle of mutual recognition, EU Member States may not prohibit the sale of products that are legally marketed in another Member State, even if they were produced under different technical standards (Regulation (EU) 2019/515 of 19 March 2019).
National laws on cannabis seeds vary between countries. In some places, germination and cultivation of cannabis for personal use, and even simple possession of seeds, can be a criminal offense. Hemp Trading, S.L. does not incite anyone to infringe the law in force in their country.
For this reason, we ask non-resident purchasers in Spain to inform themselves about the applicable local legislation. Hemp Trading, S.L. urges its customers to act responsibly.
